Another in our “Notes and the Law” series… Leave us a comment below!

Hi, Attorney Susie here again. One of my favorite professors in law school was A-OK with his students using the excuse “my dog ate my homework” to turn in a late assignment. However, in order to use the excuse, you had to produce the evidence proving your dog ate your homework. Not surprisingly, all of us opted to turn our assignments in on time rather than follow our dogs around after their “meal.”

It seems that during foreclosure proceedings these days judges are following my professor’s sage advice and requiring a foreclosing note holder (that’s you) to actually produce the ORIGINAL note to foreclose upon a property.

This isn’t standard practice in every foreclosure proceeding; it’s usually only raised when a borrower brings forth a defense asserting that the note holder doesn’t actually own the note.
OK, so what if a borrower DOES raise this defense and I don’t have the original note?

That’s where things could get a little hairy.

In most states, if you have filed a Lost Note Affidavit (LNA) along with a certified true copy of the note you MIGHT be out of the woods. Having a LNA and a certified true copy of the note will not guarantee a rubberstamp by a judge. Judges are now looking carefully at the LNAs to determine that authorized parties have executed the LNA and that it has been properly notarized.
A few examples: an unnamed bank submitted a LNA to a court and it was discovered that the LNA was executed in a different state than where it was notarized. Result: Foreclosure proceedings dismissed.

Here’s another one: a savvy judge figured out that another unnamed bank submitted a LNA executed by an individual with no authority to bind the bank. Result: Foreclosure proceedings dismissed.
Lesson to be learned: Devil is in the details–Make certain that your LNA is watertight!

Now you ask, what if I don’t have a copy of the note, can I just file a LNA?
Well, theoretically (we lawyers love theory) you can, but you would have to attach other documents to the LNA to prove that the note once existed. For example, you could provide a loan payment history, closing documents, and/or a sworn statement of the notary or escrow officer. Filing a LNA without a copy of the note is a HUGE gamble; every judge is different and it’s hard to determine how each judge will determine what evidence is needed to prove that you are the rightful owner of a note.

Most likely, if a borrower raises the defense that you are not the holder of the note and you don’t have a true and certified copy of the note, foreclosure is going to be a long, costly road.

You’ve read all this and now you’re asking yourself: I’m foreclosing on properties in non-judicial foreclosure states, why should I care?

The reality is that borrowers can raise this issue in judicial OR non-judicial foreclosure states. The principles are the same, but the procedures will be different.

To sum it up, don’t let the dog (or in this case, the bank) eat your note! When purchasing a note, make sure the seller can provide you with an ORIGINAL note – or at worst, a certified true and exact copy of the note, along with an LNA that is executed properly. If they can’t, DON’T BUY THE NOTE.

Trends at the Top: The Insider’s View

I wanted to share with you some insight from an Insider who’s a loan sale advisor. One of the “quiet types” who’s happy to work inside larger trades. Here’s a summary of what he’s seeing in the market at the upper levels. Trickle-down being what it is, I wanted to let you know what’s happening at the top …

there are a smaller number of what he calls “public market” packages – open to bidding and publicly announced through loan sale advisors

“private market packages” are selling aggressively, and in greater numbers

prices on these private packages are coming down slightly from the beginning of the year – non-performing loans (90+ del) are trading in the mid 40s; sub-performing loans are trading in the low-to-mid 40s “although lower doc types in this category settle lower” (e.g. no doc, low-doc loans trade at a lower price); and pre-REO’s (e.g. late-stage foreclosure) are trading in the high 40s – they’re pricing higher because it takes less time to get access to the underlying collateral

The fact that sub-performing is trading at a higher discount to value than non-performing indicates that the news about re-defaults is keeping expectations down on whether sub-performers can get current (see: this revealing study – 30-45% redefault, though some reports claim the redefault rate is as high as 58% within a year)

More sellers are selling loans and justifying them as a “forward REO sale”. And they’re engaging in smaller sales because ”the only way to get an idea of price on a large portfolio of loans, is to sell a small pool of loans”. Further, the insider points out that another reason for steady sales volume is due to “management periodically having to prove that ’some’ liquidity exists.”

The ARM’s are coming – the ARM’s are coming!

One other trend that’s growing is that “strategic default” – when a borrower walks away from a home with a perfect credit score – e.g. you see the following on their payhistory: 0, 0, 0, 0, 0, 0, 30, 60, 90, 120, 150 …. where they go from current and then drop off a cliff – is affecting prices. Our Insider notes that loans with one or two 30-day lates are now pricing in the 90+ delinquent range – showing “at a minimum … a lack of confidence in short-term home price appreciation (or stability). At worst, it indicates a growing realization that there are no viable modification strategies in the market place.”

2nds are trading actively

Finally, it looks like sellers are picking up the pace on selling pools of 2nds. A colleague of mine closed on a $675M package, and performing appears to be trading in the 7-16 cent range (depending on CLTV) and non-performing is still sub 1% of loan balance.

Any sign of buyers raising price expectation? Not according to the Insider: “The reality is that with continued rising unemployment, and declining home prices; there’s no reason to change a buyer’s draconian loan pricing model. Further, with 88% of all the loans in America “current”, there’s no real rationale for a Bank seller to hit a low-ball bid either…

The Gap continues….

Dean

A bank failure is not the same each time around. And they all represent different opportunities for a well-tuned note buyer.

Here are the four key things to look for in bank failure announcements:

1) Did the failed bank get taken over? There are 3 types of bank failures:

Payoffs (PO’s) wherein the FDIC actually creates a new bank to take over the bank’s deposits

Insured Deposit Transfers (IDT’s) where one bank assumes the failed bank’s liabilities (checking and savings accounts), but not its loans

Purchase-and-Assumption agreements (PA’s, in FDIC parlance), in which one bank buys the assets (loans) and liabilities (deposits) of another bank

Note: The 3rd category above is by far the most common. Through September 1, 2009, there have been 77 Purchase Assumptions; 1 Insured Deposit Transfer, and 6 Payoffs, for a total of 84 bank failures in 2009.

2) Who took over the failed bank? If a bank fails and another bank takes over its assets (which includes a bank’s loans), then pursue the acquiring bank to find out how they’ll be selling the failed bank’s loans. It’s not a matter of IF, but WHEN.

3) Finally, how exactly did they take over the failed bank? Was there a Loss Share agreement in place or not? A Loss Share, simply enough, indicates that the FDIC and the acquiring bank are sharing the losses on the loan portfolio. These are probably the best places to start in terms of pursuing note sales, since these banks will often be looking to sell off the acquired bank’s loans.

4) What’s the contact information of the acquiring bank? This seems pretty straightforward, but it’s worth checking the FDIC website rather than just Googling the acquiring bank. Here’s why: the FDIC often appoints a point of contact within itself for REO vs Note sales. Go to the FDIC website, then select “Failed Banks”, then “Failed Financial Institution Contact List”, then type in the date range you’re looking for and then search.

Write a comment below and let me know what you think,

you buy a note. And even if you don’t get everything
that you’d expect to see from the bank, I’ll share a
story with you about the missing Florida note we
bought and what happened with that deal.

Why does this matter to you when you are buying Real Estate Notes?

Because the better prepared you are for what to
expect when you buy a note, the better a negotiator
you’ll be when you’re first talking to the bank. And
the better you are at negotiating, the more
professional you’ll come across, and the better deal
you’ll get.

Each and every time.

So go out there and hit 2009 running – and take a
look at the video below to see what I expect you’ll be
doing a lot of this coming year.

To your note buying success in 2009!

On buying discounted Real Estate Notes (aka Buying Notes aka Buying Defaulted Mortgages…):

Here’s something valuable & inspiring for you.

As much as I can tell you about my own note buying successes…
I believe it is actually a lot more powerful and ‘real’
for you when I share other NoteBuyingProfits Students’ success
stories with you.

Folks like you, who took the exact buying-discounted-real-estate-notes
roadmap I laid out, studied it, and then went on to take MASSIVE
ACTION and implemented this newly-found knowledge.

So, here is the first Note Buying case study of a new
series we are starting:

* The ‘NBP Student Success Story Series’ *

This first one is with Rick from North Georgia.
His REI club buddies were laughing when he started getting
into note buying – listen in to find out who’s laughing now…

* MP3 Audio recording

* PDF doc with the transcription, if you prefer
reading

Right-click & ’save as’ both links to your computer &
listen/read it at your convenience.

Some notes on the content:

“I’d like to order a $297/month check for my $2,000
investment, please!”

It may sound like small money, but what happens when
you do a lot of small deals?

They begin to add up.
(Especially if you don’t have to waste any time on finding
deals anymore, because you created one single RELATIONSHIP
that keeps feeding you disounted real estate notes!)

And when you hear about the returns that Rick’s
getting on his first note deal, and what he’s just done on
his 2nd deal, you’ll see what it means to be able to
buy – and succeed in – non-performing notes.
—————————————————
* * * Some Note Buying Take-aways from this call * * *
—————————————————

* the secret to understanding the banker

* how to get 4 bankers to send you leads on loans
they want to sell, on the night before Thanksgiving
(this is happening NOW – I just received two more
pools today from banks wanting to close by end of month)

* how to buy a $19,000 mortgage for $2,000

* how to convince a borrower to pay you $297/month
for an investment of $2,000, FOR THE NEXT 9 YEARS

All from someone who, like YOU, is getting his feet
wet in buying discounted real estate notes.

Oh, and I forgot to tell you – Rick is the perfect example
of how to make m.oney with very very little money.

His story is the classic
“I succeeded with $2 in my pocket” type of story.

It’s all here ….

Dean

P.S. If this inspires you to make a change in your own
cash flows during this holiday season, and to take
steps to take control over your career, we’d like to
help you get there.

On how to find Notes:

$2,000 for a $297 per month cash flow.

[Who said you can only buy POOLS of notes?
Who said you need a lot of m.oney to do this?]

Now that’s what I like to hear.

This is what Rick, a www.NoteBuyingProfits.com Student,
is receiving on the very first non performing
note he recently purchased.

Here are more of the details: Rick bought a 2nd
mortgage of $20,000 (so he paid 10 cents on the
dollar), behind a 1st worth $65,000, on a house that
he estimates is worth $130,000. So he’s at
approximately a 50% CLTV ($65,000 1st plus $2,000 he
paid for the 2nd, divided by the value of $130,000).

From Rick’s perspective, this is an amazing return on
his nonperforming note investment.

From the borrower’s perspective, Rick is a … well
actually Rick’s a saint from heaven.

Here’s the way Rick explains it: “The borrower was
actually getting foreclosed on [he had lost his job
and then found employment again, but fell behind]. So
he’s about $2,000 in arrears plus he was paying an
extra $50 a month due to a bankruptcy a couple of
years ago. ” Arrears mean how much he would owe to
bring the loan current.

So his borrower was behind on his mortgage, owing
over $2,000 on a $20,000 note. And he was also paying
$50 more than the original note payment due to a
bankruptcy filing that added an extra $50 each month.
So what did Rick do with this “deadbeat” of a borrower?

He cut him some slack.

” I said to the borrower, “Listen, I’m going to eat
the arrearage, I’m going to eat the extra $50 a month,
and you just pay me $297 a month and we’re going to go
back to the original note and I’m not going to
foreclose on you. “

The result?

The borrower made the first payment and Rick expects
to have little trouble with his remaining payments.

But how did Rick get there?

How did he get started in how to find notes?

Was it tough? Did it take a lot of time? Did he know
what he was doing? Are there more of these that Rick
can do?

===> Listen in this Wednesday, December 10, 2008 at
6pm PT/9pm ET.
Dial: 419-400-0202
Access Code: 468636#

I’ve invited Rick to share his experience
with you so that you can hear how a fellow student
went from the brink of bankruptcy (it’s true, Rick
almost filed bankruptcy himself), to receiving notes
unsolicited from 4 different people at a bank, and a
million dollar investment from a fellow investor. All
within a few short months.

And where does Rick go from here with his buying notes business?

“I’m really trying
to just get one or two a month now. My plan as I build
up is to just get one every other month and then build
up to one a month, one or two a month, like next year,
and start getting into larger pools.”

Step by step, Rick is building his note buying
business. And he’s starting with nothing.

Join us for this f.ree Teleconference this Wednesday.

We have room for 100
on the call, so be sure to be on it.

Again, it’s this Wednesday, 6pm PST/9pm EST.
Dial: 773-945-1010
Panelist Access Code: 260-435-355

You will learn about/from a Student who took * MASSIVE ACTION *
on the course materials of the A-Z Note Buying Course.

Plus you can ask ANY questions of yours.

Be your success.

On How to Find Notes:

Do you remember that 1981 hit from Men at Work called
“Land Down Under?” (OK, so I was a big Men-at-Work
fan, I admit.)

Well, what made me think about it was this email that
I just received from a Korean by the name of “Joe”
(that’s what he goes by, I kid you not).

How is this related to buying Notes? Because Joe told
me a little story today that demonstrates one of the
most important lessons in the world of ‘how to find notes‘:
RELATIONSHIPS MATTER

In fact, not only do relationships matter, but
“commonalities” matter. In other words, what you want
to do when you’re looking for notes is to find out
ways to build ties with your seller.

These can be social, cultural, sports-related,
geographical, you name it. Almost any activity, sport,
hobby, pastime, event, book, play, food group or
Australian rock band can be a point of commonality.

Let me share with you Joe’s little gem of a ‘how-to-find-notes‘
story to demonstrate.

Here’s what he wrote to me today:

** I am the owner of Korean Investment club, but we
are not ready to think about buying notes yet. ( for
lack of understanding)
I was solicited last week from big Korean bank to buy
the note from the person in charge of the note.
He ask me to offer any amount for the first trust
deed with face amount of 2.5MIL or more (including
interest will be 2.7 Mil)
Collateral behind is the 79 room big motel with
restaurants. I am really interesting to buy it,
because I know it’s worth around 4MIl.
Is there any way to make it through.
Thanks for your advice.

So what are we looking at here?

We have Joe – the leader of a Korean Real Estate
Investment Club located here in th US. And we have a
big Korean Bank. And that bank has just sent a pretty
interesting lead to Joe.

Does Joe know anything about buying notes?

No – he admits as much in the first line of his email.

So do you think that he pitched to this big
Investment Bank that he would be the perfect guy to
buy their notes?

No – this opportunity just “landed” in his lap. And
from what he writes, they’re offering to him to make
“any” offer on that note.

Now for a moment, I want you to stop focusing on the
fact that Joe might actually be able to offer some
fantastically low bid on this note, like $1Mil, and
actually close this deal with this bank. That could be
incredible, yes, if the value of the collateral is
really $4Mil and if the borrower’s not performing on
the note and Joe can foreclose on the motel.

But hang on a minute. I want to point out something
that is so simple that you probably glossed over it
already, thinking that you’re supposed to be looking
for something complicated.

What kind of a bank is this? Korean. And where’s Joe
from? Korea.

So the fact that this note, which is on a California
property, happens to land in Joe’s lap, should
actually come as no surprise.

Very simply – banks often want to sell notes to
people that THEY CAN TALK TO.

And sometimes, the people they can talk to look like
them, talk like them, act like them, do business like
them, live like them, and entertain themselves like
them.

Chances are: even if I were Mr. Well Known Note
Investor and I found a way to that Korean Investment
Bank, I would probably NEVER GET THE SAME RECEPTION
AND CREDIBILITY that Joe has.

You see, they’d RATHER deal with him than you or me
because Joe is one of them in a way that you and I
never will be. So the process of “getting to know one
another” for Joe and this bank will always be a whole
lot smaller than the same process for your or me.

So get out and start applying this Note Buying Tip
101.

Find the Commonalities between You and your
Sellers.

Go find someone who speaks-a your language, and then
see if they have Notes for sale.

Talk soon,

Dean

I hope you enjoyed your turkey on Thursday!

If you are following along in our 8-part Webinar Series on
how to get you jumpstarted to buying your first note
as part of the Private Access Club (PAC) (f.ree 30-day Trial,
hint, hint), here’s an

* * * How-to-Buy-Notes EXERCISE FOR YOU TO REVIEW * * *

Find out as much as you can about what (and who)
is on title for:

43 Poplar St, in Old Town, Maine

Follow the instructions in Appendix B: the Title
Checklist from the Roadmap that you receive as part of
the A-Z Note Buying Course (in case you
haven’t ordered it already – you are getting 25% off
until including this Sunday with SPECIAL CODE ‘tg’).

Actually, I just realized that the title check list is part
of the free excerpt of those 23 pages worth of
check lists in the course.

So, check our Note Buying Checklists.

And in the coming week’s Private Access Club Session
we’ll review this together and compare results.

===> This is your opportunity to learn how to review
title on a property, and to compare notes with me as
you go.

Learning how to buy notes BY DOING.

Remember, this is the 2nd step of 8 in launching
yourself into Note Buying. Step by step.
(And all previous webinars are neatly stored in the
PAC members area for later review for you…)

And in case you don’t have the A-Z Course and want to
follow along without it, not a problem
(though you won’t get as much out of it).

Going through these steps is a VERY useful exercise.
Guaranteed.

So, join me next Wednesday at 5pm.

(Want to get a taste what those how-to-buy-notes webinars are like?
Check out the week 1 webinar on ‘How to Determine the Value of any Property’.
Accurately – without leaving your couch…’
93 minutes of no-fluff info for you. Absolutely f.ree.)

Somebody will buy those non-performing loans and profit
from them. May as well be you and me.

And there are more nonperforming notes around than any one
person or entity can handle these days…

How to buy REOs - Comparing REOs vs. Nonperforming Notes

It’s a tough choice, I know.

And I’m sure some people look at nonperforming notes and
say “why would I EVER want to own paper when I can own the real
estate for soooo cheap?!”

Well, yes. It can be cheap.

Well, yes. It is real property as opposed to a debt
obligation.

And yes, you can get rid of it pretty quickly if you
price it right.

———————————————————————

* * * So why shouldn’t everyone drop everything they’re
doing and chase REOs? * * *

———————————————————————

1. Valuation Risk.

You’ve gotta nail the home value,
and take good care of evaluating interior condition
here. It’s one thing to find yourself with a lemon
(e.g. loan), where you have several ways to turn the
lemon into lemonade (e.g. get borrower to make
payments). It’s quite another when you have a vacant
property, to try squeezing sweet juice out of this
lemon. Can obviously be done, but you should know your
area values and your interior condition much better when
buying REOS than when you’re buying notes.

2. Purchase Risk.

They can be a time waster until you
nail your sources! Usually 2-5 brokers deep in a
chain, at least one ubiquitous “attorney” who is a
fraud and huckster claiming he or she is (not has, but
“is”!) a “mandate” for someone else.

3. Deal Risk.

A friend of mine just spent 2 months
chasing one deal of 16 REOs. He just closed on 1 of
them. All the others were pulled by the seller as the
agents (all but 1 were listed) got the properties into
contract. Or they were lost to a competitor since
there were 3 brokers in between him and the seller.
The one property not pulled was … you guessed it … the
one that wasn’t already listed. The “loss ratio” on
note pools – in other words the rate at which notes
are pulled from a specific pool – aren’t as high by
any means. (One day, ask me about the west coast pool
that we lost!)

4. Discount Risk.

The discounts that you typically
hear on REOs may not be quite as juicy as you’ve been
made to believe. Unlike a “sweet” note deal that
closes in the 30%’s, REO prices in that range are
typically a pipedream. But you’ll hear pricing that
low on a regular basis.

I’m not panning REOs by any means.

Just jump in with your eyes open, and don’t get
fooled by all the hype that you’re reading about
the REO deals to be had right now.

Talk soon,

Loan Modifications… Who took my Non-performing Mortgage?

OK, so the word is out, the Doctor is in, and the medicine is … loan modifications. Specifically, principal write-downs.

Interesting.

The Hope for Homeowners initiative passed by Congress in July and officially launched a month-and-a-half ago to much acclaim, is a potentially positive FHA insurance package aiming to insure $300B of new mortgages for borrowers in a “negative equity” position.

Negative equity, of course, meaning that the loans are worth more than the home.

So … what’s the catch?

Well, the borrower has to qualify with a 31% or lower DTI ratio, at least 6 payments made and none of them late.

What do they get if they meet those magic criteria? (Oh, by the way, if I had to hazard a guess at the average DTI for loans originated in 2007, it would probably be 40-45%).

So, who’s going to qualify?

The answer is: very few people.

In the first 2 weeks of the program, exactly 49 people applied, and … none were approved.

And as for the highly touted FHA Secure program (remember that one – the one that was supposed to be the saving grace for borrowers who had missed a payment – well during the same period a total of 203 mortgage applications were filed and 49 approved.

In that same time in California, approximately 1,300 homes saw a Notice of Default filing.

So what’s the big deal here? Can’t we just give the H4H program some time?

Sure.

But remember that lenders are going to be looking for federal backing for their principal write-downs if they’re going to be participating in these 90% principal reduction plans. H4H is one of them.

So, while everyone’s waiting for the good news on H4H to come out, why not get your wallets out and make an offer on those 49 non performing notes that were just turned down?

There will be a whole lot more non-performing notes (to buy) where those come from.

Talk soon,
